Terms of service

Agreement to terms

You represent that you are at least the age of majority where you live (and at least 21 if you use features related to wagering markets where that age applies). If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

The service

StatsEdge provides analytical tools, data visualizations, and informational content about sports markets. The Service is for informational purposes only. We may modify, suspend, or discontinue features with reasonable notice where practicable.

Accounts and security

You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly at support@statsedge.app if you suspect unauthorized access.

Fees and billing

Paid plans, if offered, are billed through our payment processor (for example Stripe). Fees, renewal, taxes, and refund rules are presented at checkout and in processor or invoice terms. Failure to pay may result in downgrade or loss of access to paid features.

Acceptable use

You agree not to:

• Violate applicable law or third-party rights;
• Probe, scan, or test the vulnerability of our systems without authorization;
• Overload, disrupt, or attempt unauthorized access to the Service or other users' data;
• Reverse engineer, scrape, or resell the Service except as expressly permitted;
• Use the Service to distribute malware, spam, or misleading content.

We may suspend or terminate access for violations.

Intellectual property

The Service, including software, branding, and content we provide, is owned by StatsEdge or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal or personal purposes in line with these Terms. Feedback you provide may be used without restriction or compensation to you.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

StatsEdge does not offer gambling, custody of funds for wagering, or execution of bets. Any decisions you make based on information in the Service are solely your responsibility. Past performance and model outputs are not guarantees of future results.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATSEDGE AND ITS AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE PROHIBITED BY LAW.

Indemnity

You will defend, indemnify, and hold harmless StatsEdge and its affiliates from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or law, except to the extent caused by our willful misconduct.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or legal reasons. Provisions that by their nature should survive (including disclaimers, limitations, indemnity, and governing law) will survive termination.

Governing law and disputes

These Terms are governed by the laws of the State of Indiana, including its statutes and decisional law, without regard to Indiana choice-of-law principles that would apply another state's laws—except that if you are a consumer, mandatory consumer protection rules in the jurisdiction where you live may still apply where they cannot be waived by contract.

For disputes that belong in court (and are not subject to a separate arbitration agreement, if any), you and StatsEdge agree to the exclusive jurisdiction and venue of the state courts of Indiana and the United States District Courts sitting in Indiana, and you waive any objection to venue there based on inconvenience or lack of personal jurisdiction, except where you have non-waivable rights to sue in your home courts.

Indiana's Deceptive Consumer Sales Act and other consumer statutes may afford rights independently of these Terms. Have counsel align this section with your entity type, insurance, and whether you use arbitration for any user tier.

Changes

We may update these Terms from time to time. We will post the revised Terms and update the "Last updated" date. Material changes may require additional notice. Continued use after changes become effective constitutes acceptance unless applicable law requires otherwise.
